On August 2, 2026, the EU AI Act's transparency obligations under Article 50(4) entered full force, requiring deployers of AI systems that generate or manipulate content constituting a deepfake to disclose its artificial nature. The EU definition of deepfake is significantly broader than common usage — it includes realistic AI-generated depictions of human avatars that do not resemble identifiable individuals. A highly realistic declared AI persona qualifies as a deepfake subject to disclosure obligations even if the depicted individual does not exist.
The disclosure must be clear, unambiguous, and easily understandable — users must be able to recognize immediately that content is AI-generated without requiring technical tools or additional investigation. For Tier III engagements involving real person likeness and voice, California SB 942 and EU AI Act Article 50 both require explicit written consent.
